These Terms of Service ("Terms") govern your access to and use of ShorMachao ("ShorMachao", "we", "our", or "us"), an influencer marketing platform operated by B.K.E-Intellisense Technologies Pvt Ltd, a company registered in India with its office at 32, Ezra Street, 9th Floor, Kolkata - 700001, West Bengal, India. By accessing or using ShorMachao, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use ShorMachao. By registering, you represent that the information you provide is accurate and that you are authorised to act on behalf of any brand or entity you list.
2. Our Services
ShorMachao connects brands with content creators and influencers for marketing campaigns, including paid collaborations, barter arrangements, user-generated content, and performance marketing. We act as a facilitator and are not a party to the underlying agreement between brands and creators unless explicitly stated.
3. Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, comply with applicable platform guidelines (Instagram, YouTube, etc.), and disclose paid partnerships as required by law.
4. Payments
Campaign budgets, creator payouts, platform fees, and timelines are governed by the specific campaign agreement. Unless otherwise agreed in writing, payouts are processed after the brand confirms deliverables. Taxes (including GST and TDS) are the responsibility of the respective party as per Indian law.
5. Content & Intellectual Property
Creators retain ownership of content they produce, granting brands a usage license as defined in each campaign brief. You agree not to upload content that is unlawful, defamatory, infringing, misleading, or violates third-party rights. ShorMachao, its name, and its branding remain the property of B.K.E-Intellisense Technologies Pvt Ltd.
6. Prohibited Conduct
You agree not to misuse the platform, including by inflating metrics with bots or fake engagement, circumventing the platform to avoid fees, scraping data, or attempting to disrupt our systems. Violations may result in suspension or termination without refund.
7. Disclaimers
ShorMachao is provided on an "as is" and "as available" basis. We do not guarantee specific campaign outcomes, reach, engagement, ROI, or revenue. While we vet creators and brands, we do not independently verify every claim made by users on the platform.
8. Limitation of Liability
To the maximum extent permitted by law, B.K.E-Intellisense Technologies Pvt Ltd and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of ShorMachao. Our total liability for any claim shall not exceed the fees paid by you to us in the three months preceding the claim.
9. Termination
We may suspend or terminate your access to ShorMachao at any time for breach of these Terms or for conduct we deem harmful to the platform or its users. You may stop using the service at any time; certain provisions (intellectual property, liability, indemnity, governing law) will survive termination.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the platform or by email. Continued use of ShorMachao after changes take effect constitutes acceptance of the updated Terms.
